2. Scope and legal bases

This notice describes how we process personal data when you visit our website, contact us, request advice or use our services. Processing is carried out in compliance with the Swiss Federal Act on Data Protection (FADP, SR 235.1, in force since 1 September 2023) and the Data Protection Ordinance (DPO). To the extent that our services are aimed at people in the European Union or the European Economic Area, Regulation (EU) 2016/679 (GDPR) also applies.

We process personal data in accordance with the principles of lawfulness, good faith, proportionality, purpose limitation and accuracy. Where the GDPR applies, processing is based on the performance of a contract or pre-contractual measures (Art. 6(1)(b)), compliance with legal obligations (point (c)), our legitimate interest in running and protecting our business (point (f)) and, where required, your consent (point (a)), which you can withdraw at any time.

3. What data we process

3.1 Browsing data

When you visit the site, the server automatically records some technical data: IP address, date and time of access, pages visited, browser type and operating system, and referring site. This data is used to provide the site securely, to detect abuse and to produce statistics; it is kept in log files for a limited period.

3.2 Data you provide to us

When you fill in the contact or consultation request form, write to us or call us, we process the data you give us: first name and surname, email address, telephone number, relevant office, the content of your request and, if you state it, information about your insurance situation.

3.3 Data in the course of insurance brokerage

If you become our client, we process the data needed for advice, comparing quotes and managing policies: personal details, contract and financial data, data on the risks to be insured and on claims. Some of this data may be particularly sensitive (for example health data for personal insurance): we process it only with your explicit consent or where the law permits, and solely for the purposes stated.

3.4 Job applications

The data sent with a job application (CV, covering letter, certificates) is used exclusively for staff selection and deleted at the end of the procedure, unless otherwise agreed with the person concerned.

3.5 Claim reports

The data collected through the claim report forms (details of the policyholder and the contract, bank details, circumstances and description of the claim, attachments and, for liability claims, details of the party causing the damage and of the injured party) is processed by L+G SA solely to report and handle the claim with the insurer concerned, in accordance with the Federal Act on Data Protection (FADP). The data is disclosed to the insurer and, where necessary, to experts and other parties involved, only to the extent necessary to settle the claim.

By submitting the form, the policyholder confirms that the information provided is complete and truthful; inaccurate or withheld statements may jeopardise the right to insurance benefits.

4. Purposes of processing

  • to provide, maintain and protect the website;
  • to respond to your requests and provide advice;
  • to carry out insurance brokerage: needs analysis, requesting and comparing quotes, concluding and managing contracts, assistance in the event of a claim;
  • to comply with legal and supervisory obligations, in particular those laid down for intermediaries by the Insurance Supervision Act (ISA), including information and documentation duties;
  • to send you communications about our services and, with your consent, commercial information;
  • to produce anonymous statistical analyses of how the site is used.

5. Recipients of the data

We disclose personal data only where necessary for the purposes stated:

  • insurers and partner firms in the LG Swiss Broker network, to request quotes, manage contracts and settle claims; in the event of a claim, also experts and other parties involved, to the extent necessary;
  • service providers who process data on our behalf (website hosting, email, online forms, statistics tools), bound by contract to confidentiality and to process the data only on our instructions;
  • authorities, courts and supervisory bodies, where the law requires it.

We do not sell personal data to third parties.

6. Transfer of data abroad

Data is as a rule processed in Switzerland. Some providers (for example Microsoft for the contact form and Google for the site statistics) may process data in the European Union or the United States. In these cases we ensure that an adequate level of protection is guaranteed: countries recognised as adequate by the Federal Council, the provider’s participation in the Swiss-U.S. Data Privacy Framework, or standard contractual clauses recognised by the FDPIC and the European Commission.

7. Third-party services used on the site

  • Website forms: requests sent through the forms (contact, claims, applications) arrive directly in our mailbox and may be passed to our internal management systems (Microsoft 365) for processing. The forms are protected by Google reCAPTCHA v3 (Google Ireland Ltd.), which analyses browsing behaviour to tell people from automated programs. Privacy policy: policies.google.com/privacy.
  • Google Analytics 4 (Google Ireland Ltd.): statistics on how the site is used, activated only with your consent through the cookie banner, with shortened IP addresses. Privacy policy: policies.google.com/privacy.

  • Google Maps: the “Directions” buttons open Google Maps in a new tab; only at that moment does Google receive data.
  • Social networks: links to Facebook and LinkedIn are simple links; no data is transmitted until you click them.

For details on cookies, see our cookie policy.

8. Retention periods

  • browsing data (server logs): at most 12 months;
  • data and files sent through the website forms (contact, claim reports, applications): the copy stored on the website is deleted automatically after at most 60 days; the data continues in our internal systems for the periods stated below;
  • contact requests with no contractual follow-up: up to 24 months from the last contact;
  • contract data and brokerage documents: for the duration of the relationship and then for 10 years in accordance with retention duties (Art. 958f of the Swiss Code of Obligations, CO) and supervisory obligations;
  • job applications: up to 6 months after the selection ends;
  • records of cookie consent: 12 months.

At the end of the retention period the data is deleted or anonymised.

9. Data security

We take appropriate technical and organisational measures to protect data from unauthorised access, loss or alteration: encrypted connections (TLS), access control, system updates, backups and a duty of confidentiality for staff and suppliers.

10. Your rights

Within the limits laid down by the FADP and, where applicable, the GDPR, you have the right to:

  • obtain information about the personal data we process (right of access);
  • have inaccurate or incomplete data corrected;
  • obtain erasure of the data or restriction of processing;
  • receive the data you have given us in a commonly used electronic format (portability);
  • object to processing based on legitimate interest;
  • withdraw consent at any time, without affecting the lawfulness of the processing carried out before withdrawal.

To exercise your rights, write to info@lgsa.ch or to the postal address given in section 1. We may ask you for a document to verify your identity. We normally reply within 30 days.

You also have the right to lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC), Feldeggweg 1, 3003 Bern, www.edoeb.admin.ch, and, if you live in the EU/EEA, with the competent supervisory authority of your country.
